In Denmark, the vaping market is facing many important innovations: flavor ban, notification of zero nic, changes in fees and new requests for packaging. Let’s see together what the new obligations are and since when they apply.
Nicotine-free products
From April 1, 2021, nicotine-free vaping products must be notified.
Products already on the market on April 1, 2021 must be notified by October 1, 2021.
Flavor ban
As proposed at the end of 2019, Denmark banned the use of flavors other than menthol and tobacco in liquids with and without nicotine starting from April 1, 2021.
Liquids with flavors other than menthol and tobacco produced before April, 1 2021 can be sold until April, 1 2022.
Denmark thus aligns itself with Finland, Hungary and Estonia, where the ban on the use of flavorings is already in place. These countries could be followed by Lithuania and the Netherlands, which have recently proposed similar measures.
Packaging with standardized design
From October 1, 2021 the individual and external packaging of vaping products with and without nicotine will have to be standardized, according to details still being defined.
In addition, a product ID code must be applied to each individual package and any external packaging.
For e-cigarettes and refill containers manufactured before October 1, 2021, the law will not apply until October 1, 2022.
Fee
As communicated by the Danish Safety Technology Authority, from April 1, 2022 new tariff models will come into force, the details of which have not yet been communicated.
From April 1, 2021 to March 31, 2022 the amounts of the notification and annual fees will be calculated daily based on the established rate.
