Trade with the UK from 1 January 2021

Since 1 January 2021, the UK is no longer part of the single market and has left the customs union and EU policies.

We have already described here the main variations for the regulation of the vaping industry. We now want to introduce important updates regarding trade.

An “agreement in principle” with the United Kingdom was reached on 24 December 2020, defining EU-UK cooperation from 1 January 2021. It regulates a wide range of areas of strategic interest, including trade between the United Kingdom and the countries of the European Union, providing for the absence of duties for goods that comply with the appropriate rules of origin.

The agreement allows companies to declare the origin of goods and provides that companies can take into account not only the original materials used, but also if the substantial processing took place in the United Kingdom or in the European Union.

The attestation of origin can be made by the exporter, who is responsible for the correctness of the attestation of origin and the information provided, on an invoice or any other document that describes the original product in sufficient detail to allow its identification;
it is valid for 12 months from the date it is issued and may apply to a single shipment of one or more imported products or to multiple shipments of identical products imported within the period specified in the attestation of origin, which must not exceed 12 months.
The declaration under the agreement can be made in the languages ​​of all EU countries.

The obligation to perform customs procedures remains unaffected, albeit facilitated by the agreement.
